FOUNDER, PRINCIPAL ATTORNEY

Edward C. Greenberg

Ed Greenberg has been a litigator, lecturer, author, civil court mediator and expert witness on matters concerning intellectual property and model's rights for over 40 years.  He litigates regularly in the Federal and State Courts having appeared as counsel in well over one thousand cases. 

Ed actually goes to court and tries real cases in front of actual judges and juries. He has appeared before the trial courts of several states, has argued appellate cases at the State and Federal levels, and has served as an expert witness retained by other attorneys in photo related matters.

These cases include: copyright infringement actions, violations of rights of publicity/privacy, photographer/agent disputes, photographer/ad agency disputes, disputes regarding the use of a model's images in violation of state or Federal law, and matters involving model agencies.  He has tried several cases involving the failure of stock agencies to return imagery and/or pay sums due contributors.

He has been on the faculty and now lectures regularly at The School of Visual Arts in New York, has lectured at a dozen Photoshop World conferences, has represented the American Photographic Artists (APA), Editorial Photographers  of America (EP) and the Society of Illustrators.  Along the way he has authored or co-authored numerous publications and appears in countless videos and webinars often with famed photographer Jack Reznicki (Former President of PPA). Mr. Greenberg has also co-authored proposed legislation for the US Congress with Prof. Nimmer and others.  His most recent book "The Copyright Zone" authored with Mr. Reznicki, is currently in use as a text book or required reading at several colleges and universities.

Joshua S. Broitman

Josh Broitman is an intellectual property attorney with more than 25 years of experience counseling large corporations, small businesses, start-ups and individuals in the development, protection, enforcement and defense of their patent, trademark, trade dress and copyright assets.  He has been a partner at New York City intellectual boutique firm Ostrager Chong Flaherty & Broitman P.C. since 1998.  Josh prides himself on bringing a practical, business-oriented approach to all types of patent, trademark, trade dress, copyright or unfair competition issues for his clients.

Josh has provided counsel to a broad range of clients in diverse industries regarding product design, adoption of trademarks, service marks and trade dress, patent and trademark portfolio strategy and management, including rendering opinions regarding patentability, patent infringement, patent invalidity and enforceability issues, freedom-to-operate opinions, and trademark clearance opinions for use and registration.  He regularly drafts and negotiates license agreements and related intellectual property documents, and provides counsel regarding strategies for asserting and defending patent, trademark, copyright, and unfair competition claims.  In that regard, Josh has participated in many litigation proceedings in U.S. federal courts and trademark opposition and cancellation proceedings before the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board, including managing discovery, taking and defending depositions, drafting memorandum of law and arguing motions. 

Josh has also drafted and prosecuted hundreds of patent and trademark applications, and has technical experience in the mechanical, electrical, electro-mechanical and industrial systems arts, and a broad spectrum of technologies and businesses including nonwovens, aerospace, medical devices, telecommunications, consumer electronics and toys, financial news and others.
